1. Introduction & Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Svara AI software application, website, and related services (collectively, the "Service"), operated by Svara AI ("we", "us", or "our").

By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Svara AI provides specialized artificial intelligence-powered voice dictation and text-formatting software.

  • The Service captures audio, converts it to text, and processes it using AI to format and execute commands.
  • Privacy Guarantee: The Service processes text inputs to generate outputs but does not permanently store voice or audio recordings. Audio is processed dynamically in real-time.

3. License to Use the Service

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Svara AI application for your personal or internal business use. You may not:

  • Reverse engineer, decompile, or disassemble the Service.
  • Resell, lease, or sublicense the Service.
  • Use the Service to build a competitive product.

4. Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

5. User Responsibilities & Acceptable Use

You are solely responsible for the audio you dictate, the text you input, and the resulting outputs you choose to utilize. You agree not to use the Service to:

  • Generate, process, or distribute illegal, harmful, defamatory, or highly offensive content.
  • Violate the intellectual property rights or privacy rights of any third party.
  • Attempt to hack, disrupt, or compromise the integrity of our servers or networks. We reserve the right to immediately suspend or terminate accounts that violate these rules.

6. AI Technology Disclaimer (Assumption of Risk)

Svara AI utilizes advanced machine learning and artificial intelligence models. By using the Service, you acknowledge and agree that:

  • Accuracy: AI-generated outputs may sometimes be inaccurate, grammatically flawed, incomplete, or entirely fabricated (often referred to as "hallucinations").
  • No Professional Advice: The Service does not provide legal, medical, financial, or professional advice.
  • User Verification: You are entirely responsible for reviewing, verifying, and editing all AI-generated text before publishing, sending, or relying upon it.
  • Release: We make no warranties regarding the correctness, reliability, or quality of the outputs, and you use them entirely at your own risk.

7. Subscriptions, Billing, and Payments

  • Subscriptions: Svara AI operates on a subscription-based model. By subscribing, you expressly authorize us to charge you recurring fees according to your selected plan.
  • Payment Processor: All payments are processed securely via our trusted third-party gateway, Razorpay.
  • Pricing Changes: We reserve the right to modify our pricing structure at any time. Active subscribers will receive prior notice of any changes to their recurring fees.

8. Refunds & Cancellations

  • Cancellations: You may cancel your subscription renewal at any time through your account settings. You will retain access to the Service until the end of your current billing cycle.
  • Refunds: All subscription charges are generally final and non-refundable. Exceptions or prorated refunds may only be granted at our sole and absolute discretion. (Please refer to our Refund Policy for comprehensive details.)

9. Intellectual Property Rights

  • Our Rights: The Svara AI platform, its source code, branding, logos, and UI designs are the exclusive property of Svara AI.
  • Your Rights: You retain all ownership rights to the original content you input into the Service. Subject to these Terms, you are free to use, distribute, and commercialize the AI-generated text outputs produced by the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF BUGS OR MALWARE.

11. Limitation of Liability

IN NO EVENT SHALL SVARA AI, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE. IN ALL CASES, OUR MAXIMUM AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Svara AI and its operators from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat.
